August 21 2020 — Today, the first procedural hearing took place before five judges of the High Court of Justiciary. Sadly, Amer Anwar — the lawyer for Megrahi’s family — is repeating all the old mistakes that brought us this spectacular miscarriage of justice, including a grandiose press release, that is rid with nonsensical, erroneous, illogical, and counter-productive statements. Let me start with the following quote from The Herald of Scotland.

Appeal lawyer Aamer Anwar on behalf of the family of the late Al-Megrahi said they need to move the court to consider granting authority to see certain “important” documents “over which public interest immunity is asserted”.

He said: “Our argument is that public interest immunity certificate is not everlasting, it has been 31 years since the bombing and the UK Government represented by the Advocate General should justify why it is still asserting PII and denying full disclosure of this information to our team.”

He added: “We are disappointed that the Scottish Government, the UK Government, the United States and other foreign governments have refused consent to disclose matters which at this time remain redacted in papers disclosed to us.”

In truth, the UK Government — represented by the Advocate General — will have no difficulty whatsoever to justify why it is still asserting Public Interest Immunity.

Worse, if these documents were to be disclosed, they would not help Megrahi’s case. In fact, they are at best irrelevant, and possibly reinforcing the case against him and Libya.

Finally, we already know the content of these documents, and they could not be used in this appeal because they deal with an issue that was rejected by the SCCRC.

Let me explain. Once more…

Public Interest Immunity over these documents is asserted not because of the information related to Lockerbie, but because of the implications regarding relatively recent events.

Put it simply, two pieces of intelligence, even produced decades apart, can be used to identify a source.

I am usually skeptical when a government hides behind National Security. But, I believe that the disclosure of these documents could indeed cause great harm.

I am quite sure that a person authorized to read these documents, and properly instructed about these recent events, will agree with my analysis.

Still, let us move on and assume that the documents are disclosed to Mr Anwar. What then?

Actually, we already know the content of these documents as it pertains to the Lockerbie Case.

These documents allege that individuals not related to Libya had also access to the infamous MST-13 timers alleged to have triggered a bomb aboard Pan Am 103.

This could be used to entertain wild conspiracy theories — Iran did It! — if it was not for the fact that we KNOW that PT/35(b) — the central piece of evidence in this case — does NOT come from a MST-13 timer.

So, who cares who may have received these timers beside Libya since we know that  PT/35(b) is not a fragment of these timers?

This is not only illogical, it is counter-productive for the defense of Megrahi as it seems to give more weight to the MST-13 story which is obviously a fairy tale.

Finally, what would Mr Anwar do with this information? The SCCRC has already refused to accept the ground of appeal regarding PT/35(b) and the MST-13 timers. So it is totally useless at this point in time.

Allow me one more comment. Why did the SCCRC refuse to accept the ground of appeal regarding PT/35(b) and the MST-13 timers despite its paramount importance for this case?

Very simple. Mr Anwar made the claim that the evidence about PT/35(b) was discovered AFTER the Lockerbie trial. Yet, another popular fairy tale in some circles…

As I explained a decade ago, nothing could be further from the truth. All information about PT/35(b) was available to the defense lawyers well before the trial, including the difference in the metallurgy of the copper tracks.

Why was that exonerating evidence not used to prove the innocence of Megrahi — and Libya — is a complete mystery.

Why Mr Anwar falsely claimed that this was new evidence is totally incomprehensible.

But the consequences of Mr Anwar’s false claim to the SCCRC are very clear.

This appeal has barely started, but it is already a complete fiasco. All hopes for the TRUTH are gone. This trial will not bring closure to anyone.

PS — On November 29 2017, following an interview with the former justice secretary on his chat show on the Kremlin-backed TV channel RT, Alex Salmond [First Minister of Scotland from 2007 to 2014] said:

“Is it possible for someone to be guilty, yet wrongly convicted? Yes it is.

Kenny MacAskill was correct, the forensic evidence compiled by the Scottish authorities and the FBI clearly identified Libyan involvement and Malta as the place where the bomb was planted.

Mr Megrahi was a high ranking Libyan intelligence official on the scene at the time.

This supports the charge that he, acting with others, was part of the Lockerbie conspiracy.”

To my readers, I have a simple question.

Why would anyone pick a lawyer such Mr Anwar when even his best known friend does not believe him about the innocence of Mr Megrahi ? Please, think about that.
